1. Who we are and what these Terms cover

catchy-me is an online service that finds B2B leads and helps you prepare the first contact with them (the "Service"). The Service's website is catchy-me.com.

The Service is run by Ivan Liangasov pr Računarsko programiranje Liangas Beograd (Stari grad), a sole proprietor (preduzetnik) registered in the Republic of Serbia ("we", "us"):

  • address: Kraljice Natalije 11/2, Stari Grad, 11000 Beograd, Serbia;
  • registration number (matični broj): 66774244;
  • tax ID (PIB): 113368875;
  • email: support@catchy-me.com.

These Terms of Use (the "Terms") are the agreement between us and you as a user of the Service. If you register on behalf of a company, that company is the party to the agreement, and "you" means both the company and you as its representative.

How we handle personal data is explained in our Privacy Policy, and which cookies and browser storage we use is explained in our Cookie Policy. These documents are information for you. You do not need to accept them, and they are not part of the agreement.

2. How the agreement is made

The agreement is made when you register:

  1. You enter your name, email address and password.
  2. You tick a box to accept the Terms and to confirm that you use catchy-me for work or business, not for personal purposes. The box is not ticked in advance, and no account is created without it.
  3. We send a code to your email address. The agreement is made once you enter the code and your account is created.

You can correct mistakes in your name, email or password on the form before you enter the code. Later, you can change your name, language and password in the account settings, and anything else through support.

We record which version of the Terms you accepted, when, from which IP address and from which browser (user agent). We need this to show that the agreement was made.

The Terms are available in Russian and English. The current text, with its version and date, is always at /terms, where you can save or print it. We will send earlier versions on request.

Registration may be open, by invitation only, or closed. We may require an invitation or close registration for a while at any time.

3. Business use only

catchy-me is meant for professional use by companies, entrepreneurs and their staff. By registering, you confirm that:

  • you are at least 18 years old;
  • you use the Service for work or business, not for personal, family or household purposes;
  • if you act for a company, you have the authority to enter into agreements like this one on its behalf.

If you nevertheless turn out to be a consumer, you keep the rights that the mandatory consumer protection law of your country gives you. Any part of these Terms that conflicts with that law does not apply to you.

4. What catchy-me does

You describe your ideal customers, and the Service:

  • searches public professional sources and B2B data providers for matching people and companies;
  • gathers facts about each lead, with links to the sources;
  • assesses how well each lead fits your description;
  • uses AI to write personal first messages for email and social networks;
  • exports the results to an xlsx file.

After you sign up, an AI assistant helps you get started: it reads your company's website and helps you describe your goals, audiences and ideal customer.

catchy-me never sends messages. You copy the texts and send them from your own accounts yourself. We do not ask for or keep logins, passwords or access tokens of your email, social network or any other accounts.

AI is used at almost every step. We keep adding features. Some of them are marked as beta: they may be unstable, change or be removed.

5. Your account

  • Give accurate details and keep them up to date.
  • An account is for one person. Do not share your password or your account.
  • Keep your password secret. You are responsible for everything done in your account.
  • If you suspect that someone else has used your account, change your password at once and write to us.

Our staff may look at account data for support, billing and security. To investigate a problem, a staff member may enter your account and see what you see. Such a visit lasts no more than 30 minutes, cannot change your settings or password, and is recorded in a log.

6. Balance, credits and payment

Credits

The Service runs on a prepaid balance kept in whole credits. The credit rate is shown in your account; by default, 1 credit = USD 0.01. Credits do not expire. Your top-ups and charges are listed in the account settings.

What an action costs

Billable actions are lead searches, facts on request, outreach texts and their rewrites. The cost of an action is the cost of the third-party services it needs (data, AI models, page loading). It is converted to credits and rounded up to a whole credit. Exactly that whole number is deducted from your balance.

The onboarding with the assistant and setting up a search are free.

The packages on our website (for example, USD 100 for about 50 leads) are a guide, not a price plan. What you are actually charged is the cost of each action.

Estimate and hold

Before a search starts, you see an estimate, and the estimated amount is held on your balance. The actual cost may be higher or lower than the estimate: it depends on how many people have to be checked and on what the providers charge. When the action is finished, any unused part of the hold returns to your free balance.

Negative balance

When no free credits are left, a search may exceed its estimate by up to 25% and then stops. Outreach texts and rewrites are never stopped for lack of money. So your balance can go slightly below zero. You owe us the negative amount, and it is deducted from your next top-up. While your balance is negative, a new search will not start.

Top-ups

There are no card payments in the Service. You top up your balance by invoice or bank transfer; agree the amount and method with support. Credits are added once the money arrives.

Prices do not include VAT (PDV). Where a tax applies, it is added to the price. You pay your own taxes and bank fees.

Price changes

We change the credit rate and the pricing rules as described in section 17. Such changes do not affect a search that has already started. Providers change their prices independently of us, and a new estimate takes that into account.

Refunds

Top-ups are not refundable, except that:

  • if an action was not performed through our fault, the credits charged for it are returned to your balance;
  • if we stop the Service, or close your account when you have not breached these Terms, we refund the unused positive balance in money;
  • we refund where the law requires it.

Limits

To keep the Service working for everyone, fair-use limits apply to the number of calls to the assistant and to the number of new searches per month. The limits may change and may in future depend on the plan. Support can tell you the current values.

7. Your data and the results

Everything you put into the Service (your company description, goals, ideal customer description, exclusion lists and sender details) remains yours. You allow us to process it as far as needed to run the Service: to store it, to pass it to the providers listed in our Privacy Policy and to show you the results.

We claim no rights in the texts and exports the Service makes for you. You may use them only for your own company's B2B prospecting. You may not resell the results, publish them or build a database from them for third parties.

If you upload data about other people (for example, a list of people you already know and want excluded from a search, or the details of a colleague who will send the messages), you must have a lawful basis for it. We handle such data on your instructions. We will provide a data processing agreement (DPA) on request.

8. Your responsibility for people's data and for your messages

When you take data about people from the Service and use it, you become an independent controller of that data. You are responsible for your messages and for whom you contact. Data protection laws (the GDPR, the Serbian Law on Personal Data Protection, ZZPL), anti-spam laws (such as CAN-SPAM in the United States) and similar laws in other countries require you to:

  • have a lawful basis for contacting each person;
  • say in your very first message who you are, where you got their data (catchy-me and the sources shown in the results) and how they can opt out of further messages, as Article 14 of the GDPR requires;
  • act on opt-outs and objections at once, and keep your own list of people who opted out;
  • not contact people who opted out or objected;
  • follow the anti-spam rules of the recipient's country. For example, in Germany email advertising needs prior consent even in B2B; in Serbia, electronic commercial messages also need prior consent; in the United States, CAN-SPAM requires honest headers, your postal address and a working opt-out;
  • follow the rules of the platforms you send from: social networks and email providers.

If someone asks you to delete their data, tell us, and we will delete it from the Service.

We recommend, but do not require, that you tell recipients a text was prepared with AI.

To repeat: catchy-me does not send messages and does not act for you on any third-party platform.

9. Acceptable use

You may not use the Service:

  • for any unlawful purpose;
  • for spam or bulk unsolicited messages where the law forbids them;
  • to harass, threaten or pressure people;
  • to discriminate;
  • to collect, infer or use special categories of data (health, religion, political opinions, sexual orientation, ethnic origin, trade union membership and the like), or to build profiles on them;
  • to contact or look for minors;
  • to contact people outside their professional role;
  • for fraud, phishing, impersonating a person or a company, or misleading claims.

You also may not:

  • get around the Service's limits and restrictions;
  • access the Service with programs, bots or scripts unless we have allowed it;
  • collect data from the Service automatically (scraping);
  • probe the Service for vulnerabilities, break into it or overload it;
  • decompile the Service or try to reconstruct its code;
  • resell access to the Service or share your account;
  • automate your own social network or other platform accounts or break those platforms' terms.

10. Public sources and third-party platforms

Data about people and companies comes from public sources and from B2B data providers. We do not guarantee that it is complete, accurate, up to date or always available. A source may close, change or stop providing data. We may then replace it or remove a feature.

We may delete data from the Service, including from your results, when the law, the person the data is about, or a rights holder requires it.

The terms of social networks and other platforms apply to your accounts on them. We are not affiliated with these platforms, and they have not endorsed the Service.

11. AI and generated content

Texts, facts and fit assessments are produced with third-party AI models. The onboarding assistant is an AI system, and the Service tells you so.

AI makes mistakes. It can misread a source, mix people up or invent a fact. So check every text, and the facts it is built on, before you send it. The source links are there for that.

We do not train our own models on your materials. AI providers process data under their own terms; see our Privacy Policy for details.

12. Intellectual property

The Service, its code, design, the name catchy-me and its logo belong to us or our licensors. While your account is active, you may use the Service under these Terms. This is a limited, non-transferable right, and you get no other rights in the Service.

If you send us feedback or suggestions, we may use them freely and owe you nothing for them.

13. Availability and changes to the Service

We try to keep the Service running without interruption, but we do not promise any particular level of availability. The Service may be unavailable because of maintenance, updates, or failures on our side or at our providers. We try to announce planned work that will stop the Service for long.

We may change, add and remove features. If a change noticeably reduces what you have already paid for, we will warn you in advance where we can.

14. Liability

The Service is provided "as is". We do not guarantee that it suits your purposes, that the results are accurate or that a search will win you customers.

To the extent the law allows:

  • we are not liable for indirect or consequential losses, lost profits, or loss of data, goodwill or opportunities;
  • we are not liable for how third-party services and platforms work;
  • our total liability under the agreement is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

These limits do not apply to harm caused intentionally or through gross negligence, or in any other case where the law does not allow liability to be limited. For consumers, they apply only as far as mandatory consumer protection law allows.

15. Indemnity

You will compensate us for losses and costs (including reasonable legal fees) arising from third-party claims caused by how you use the results, by your messages, or by your breach of the law or of these Terms.

16. Suspension and termination

You may stop using the Service at any time. To close your account, write to support@catchy-me.com from the address the account is registered to. We will close the account and delete its data within 30 days, as described in our Privacy Policy.

We may suspend your account or some of its features if:

  • you breach these Terms;
  • your actions put other people, the Service or us at risk;
  • you have not repaid a negative balance after our reminder;
  • the law or a public authority requires it.

We may end the agreement after giving you notice, or at once in case of a serious breach. If we stop the Service as a whole, we will give at least 30 days' notice.

After your account is closed, its data is kept and deleted as described in our Privacy Policy, and the remaining balance is handled under section 6. The sections on liability, indemnity, balance debt and disputes continue to apply after closure.

17. Changes to these Terms

Material changes are changes to prices and credit rules, liability, acceptable use and governing law. We email you about them at least 30 days before they take effect, unless the law requires a change sooner. After that date, the Service will ask you to accept the new version when you log in. If you do not agree with it, you can close your account before the changes take effect.

Other changes (wording, contact details, corrections) take effect when published. The version and the date of the last update are shown at the top of the page.

18. Governing law and disputes

These Terms are governed by the law of the Republic of Serbia. If a dispute arises, please write to us first: we will try to resolve it within 30 days. If that fails, the dispute goes to the courts of Belgrade.

If you are a consumer, you keep the rights given to you by the mandatory rules of your country, including the right to go to the court where you live where the law gives you that right.

19. Miscellaneous

  • Severability. If any provision turns out to be invalid, the rest remain in force.
  • No waiver. If we do not use a right at once, we have not given it up.
  • Assignment. We may transfer the agreement to a successor of our business and will tell you if we do. You may transfer it only with our written consent.
  • Notices. We write to you at your account's email address or in the Service, and you write to us at support@catchy-me.com.
  • Languages. The Russian and English versions of the Terms have equal force. If they differ, the English version prevails.
  • Force majeure. We are not liable for delays and failures caused by events beyond our control: natural disasters, failures of communications and power, provider outages, decisions of authorities.
